Terms and Conditions IEP Binder App 1. Introduction Welcome to the IEP Binder App ("App"). These Terms and Conditions ("Terms") govern your access to and use of the App and its related services. By using the App, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you must not use the App. 2. Purpose of the App The IEP Binder App is designed to help parents, guardians, and caregivers organize and manage information related to children with Individualized Education Programs (IEPs) and 504 Plans. The App allows users to: store and manage child-related records; maintain professional contact information; track communication logs and patterns; save and organize documents (e.g., IEPs, letters, medical notes); generate and compile organized digital binders; use AI-powered features to read, analyze, and extract information from uploaded documents, including IEPs and 504 Plans. The App is intended for organizational purposes only and does not provide legal, medical, or educational advice. 3. Eligibility You must be at least 18 years old to use the App. By using the App, you represent that you are a parent, legal guardian, or authorized caregiver, or that you have the legal authority to store and manage the information you upload. 4. User Responsibilities You agree to: provide accurate and complete information; maintain the confidentiality of your account credentials; use the App only for lawful purposes; ensure you have proper consent to store, manage, and submit for AI processing any child-related or third-party data. You are solely responsible for all content uploaded to the App, including any content processed by AI features. 5. Use of Artificial Intelligence (AI) The App incorporates AI technology to assist users in organizing and managing their documents. By using the App's AI features, you acknowledge and agree that the AI may read, process, and analyze documents you upload, including IEPs, 504 Plans, medical notes, evaluation reports, and other sensitive educational records. AI-generated outputs are provided for organizational assistance only, may contain errors, and are not a substitute for professional legal, medical, or educational advice. AI functionality may be powered by third-party providers. If you do not wish your documents to be processed by AI, you may choose not to use AI-powered features. 6. Data and Privacy The App may store sensitive personal information including child-related educational records, medical notes, professional contact details, uploaded documents, and AI-generated summaries. By using the App, you consent to the collection, storage, processing, and AI analysis of this data in accordance with the Privacy Policy. 7. Data Ownership You retain full ownership of all content and data you upload. By using the App, you grant us a limited license to store, process, and display your data to provide App functionality. We do not claim ownership over your content. 8. Prohibited Use You agree not to upload unlawful or fraudulent content, attempt unauthorized access to the App, use the App to store data you do not have rights to manage, interfere with App operation or security, or attempt to reverse-engineer AI models or outputs. 9. Disclaimer of Warranties The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted service, data integrity, or that AI-generated outputs will be accurate or complete. 10. Limitation of Liability To the fullest extent permitted by law, we are not liable for loss of data, indirect or consequential damages, or decisions made based on information stored in or generated by the App. 11. Data Backup and Responsibility You are responsible for maintaining backups of important documents. The App should not be your sole backup solution. 12. Account Termination We reserve the right to suspend or terminate your account if you violate these Terms, misuse the App, or if required by law. You may stop using the App at any time. 13. Changes to Terms We may update these Terms at any time. Continued use after changes are posted constitutes acceptance. 14. Intellectual Property All App features, design, branding, and AI models are the intellectual property of the App owner and may not be copied or reused without permission. 15. Third-Party Services The App may integrate with third-party services. We are not responsible for the performance or policies of those services. 16. Governing Law These Terms are governed by the laws of the applicable jurisdiction where the App operator is based. 17.
